GUIDELINES, TERMS AND CONDITIONS

CISPATA PROMOTORA HOTELERA S.A. in Restructuration, is a legally constituted organization with National Tourism Registry No. 1942, which develops activities dedicated to tourism within the national legal framework and complies with all current regulations, especially the provisions of the liability regime established by the General Tourism Law – (Law 300 issued in 1996).

  • When failure to comply in whole or in part with the services offered or agreed, or when oversold, tourists will have the right, to receive another service of the same quality, or a refund or compensation for the failed service.

  • Provide the users with evidence that specifies the services they have contracted and the terms offered and agreed upon; specifying estimated arrivals and departure times, check in and check out, in order to establish the services included in the plan they have purchased.

  • Advise and inform guests about all the conditions related to their reservations and in general about their obligations for the correct use of the services contracted.

  • Provide a cordial and respectful care to our guests, addressing their concerns and requests promptly.

  • CISPATA MARINA HOTEL assumes no responsibility with the guests for services contracted directly by them with third parties.

  • – CISPATA PROMOTORA HOTELERA S.A. is exempt from all responsibility in relation to the obligations contracted when incidents of force majeure occur. These are external, abnormal and unforeseen circumstances, the causes of which are unavoidable despite all diligence on the part of the Hotel. In accordance with current legislation these acts are especially caused by nature such as tsunamis, earthquakes, hurricanes or similar.

  • – CISPATA PROMOTORA HOTELERA S.A. in compliance with what is established by Law 679 issued in 2001 and regulated with Law 1336 issued 2009; is committed to the Code of Conduct, against sexual exploitation and rape, in order to protect minors. The legal consequences of these behaviors are established in Chapter II of the Penal Code.

  • CISPATA PROMOTORA HOTELERA S.A. in Restructuration – The manager and operator of the «CISPATÁ MARINA HOTEL” wishes to inform the general public that pursuant to Law 1581 issued in 2012 and Decree 1377 issued 2013; it is committed to safeguarding your privacy and the information you supply which we receive in relation to our commercial relation; thus it guarantees the protection of rights such as Habeas Data, privacy, intimacy, good name, image and autonomy. For this purpose, all actions are governed by principles of good faith, legality and transparency.

  • – CISPATA PROMOTORA HOTELERA S.A. in Restructuration, will always consider that personal data is the property of the people to which it refers, and only they can decide about it.

  • CISPATA PROMOTORA HOTELERA S.A. reserves the right of admission to pets in the hotel facilities, in accordance with its internal guideline «Policies and Conditions of Admission of Pets»

– When the user of tourist services is in breach for failing to appear, or not to use the services agreed, the Hotel may ask you to choose between making a 20% payment of the full price or rate established, or retain the deposit that was previously received from the user.

CISPATA MARINA HOTEL CANCELLATION POLICIES AND REFUNDS

The amount of the refund is governed by the following terms:

  • Cancelation with 30 or more days in anticipation of the date booked, 90% of the deposit will be refunded./p>

  • Cancelation between 29 and 15 days, 75% of the deposit will be refunded.

  • Cancelation between 14 and 5 days, 50% of the deposit will be refunded

  • Cancelation with less than 5 days before the date booked no refund of the deposit will be made.

CUMPLIENDO CON LO DISPUESTO EN LA LEY 300- Titulo VII – Capitulo II – Articulo 65

  • If the users wish to extend or renew the services contracted they must inform CISPATA MARINA HOTEL with a reasonable anticipation

  • The Hotel according to availability will accept or reject their request.

  • Comply with the recommendations and restrictions outlined by the hotel staff.

  • At all times give the staff a cordial and respectful treatment.

CISPATA PROMOTORA HOTELERA S.A. in Restructuration which bears National Tourism Registry No. 1942, it is governed by the following Legislation:

General Tourism Law – Law 300 issued in 1996.

  • Article 63 – Provide the user with the services contracted in accordance with the terms offered and agreed.

  • Article 64 – Refund or compensate the user, in case of partial or complete failure in providing the services contracted in accordance with the terms offered and agreed.

  • Article 65 -The Hotel may charge according to its sole discretion a penalty fee for up to 20% of the total price of the agreed services in the case of cancellation of a confirmed reservation or failure in using the services agreed;

  • – Article 66. If the user wishes to extend or renew the services agreed he shall proceed to communicate this to the Hotel with reasonable anticipation and this is subject to availability.

The Hotel is a smoking free space which ensures the health rights of its guests, especially that of minors and of the nonsmoking population.

LAW 17 issued in 1981

Law 679 issued in 2001

In accordance to this law, tourists are warned that pornography, exploitation and sex tourism of children in the country are criminal actions, that have penal and administrative sanctions.

Law 1336 issued in 2009

With which Law 679 of 2001 is added and strengthened in order to combat exploitation, pornography and sex tourism with children and adolescents.

Law 124 issued in 1994

With which the sale of alcoholic beverages to minors is prohibited.
